1. About this policy

Builders Choice Limited trading as Builders Choice (ABN 91 689 205 776) (Builders Choice, we, us or our) is an independent building brokerage operating across Perth and Melbourne. We take the privacy of the people we work with seriously.

This Privacy Policy explains what personal information we collect, why we collect it, who we share it with, how we keep it secure, and how you can access it, correct it or make a complaint. It applies to our website at [www.builderschoice.com.au], to our online tools and forms, and to all of the services we provide.

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

2. What personal information we collect

The personal information we collect depends on how you interact with us. It may include:

  • Identity and contact details — your first and last name, email address, phone number and postal address.
  • Build and property information — where you are building, whether you already own land, block or lot details, your budget range, design and inclusion preferences, intended timeframes, and anything you choose to tell us in the “Tell us about your build” field or during a consultation.
  • Eligibility and financial information — where you use our eligibility check or ask us to review your finance position, this may include your deposit, income, existing borrowings, borrowing capacity, first home buyer status, grant or concession eligibility, and whether you hold a pre-approval.
  • Consultation preferences — your preferred consultation date and time, and how you prefer to be contacted.
  • Records of our dealings — notes of calls, meetings and site visits, emails and text messages, your enquiries and our responses, and any feedback, review or testimonial you provide.
  • Website and technical information — your IP address, device and browser type, the pages you visit, how long you spend on them, and the site that referred you. See section 8.
  • Recruitment information — if you apply for a role with us, your resume, work history, qualifications and referee details.

We do not generally collect sensitive information (such as health, racial or ethnic origin, religious beliefs or political opinions). If we ever need to, we will ask for your consent first, unless the law permits otherwise.

You can deal with us anonymously or under a pseudonym — for example, when making a general enquiry about how building brokerage works. However, we usually cannot match you with a builder, assess your eligibility or arrange a consultation without your contact details.

3. How we collect personal information

Directly from you

Most often we collect personal information straight from you — when you complete our free consultation form or eligibility check, use a tool on our website such as the Home Visualiser, call or email us, speak with one of our brokers, or meet with us in person.

From third parties

Sometimes we collect personal information about you from others, including:

  • builders in our network, where you have contacted them directly or they are responding to an introduction;
  • mortgage brokers, lenders and other finance partners, with your consent;
  • land developers, estate sales staff and real estate agents, where relevant to a house and land opportunity;
  • people who refer you to us, such as a friend, family member or a professional adviser; and
  • publicly available sources, such as property listings, land registries and business directories.

Where we collect your personal information from someone other than you, we take reasonable steps to let you know that we hold it and why, unless you would reasonably expect us to have it.

Our website collects some technical information automatically through cookies and similar technologies. See section 8.

4. Why we collect, hold, use and disclose personal information

We collect and use personal information so we can act as your independent building broker. Specifically, we use it to:

  • respond to your enquiry and arrange your free consultation;
  • understand your goals, budget, block and timeframes so we can give you relevant guidance;
  • assess, on an indicative basis, your eligibility for grants, concessions and building pathways, and review your finance position;
  • identify builders we consider well suited to your project, and provide those builders with the information they need to respond to you (see section 5);
  • refer you, where you ask us to, to mortgage partners, finance brokers and other service providers;
  • support and advocate for you through the building process, from planning through to handover;
  • operate and improve our business, including record keeping, staff training, quality assurance, and handling complaints;
  • send you marketing and updates about our services, builders, house and land opportunities and the building market, where you have not opted out (see section 6); and
  • meet our legal, regulatory, insurance and record-keeping obligations.

We will only use or disclose your personal information for another purpose where you would reasonably expect it and that purpose is related to the one above, where you have consented, or where the law requires or permits it.

5. Who we share your personal information with

Builders in our network

Introducing you to builders is the heart of what we do, so this disclosure matters most. When you ask us to match you with a builder, we share with the builders we shortlist the information they need to assess your project and respond — typically your name and contact details, where you are building, your block or land details, your budget range, your design preferences and your intended timeframes.

We only do this where you have asked us to match you with a builder or have otherwise agreed to the introduction. Once a builder holds your personal information, they manage it under their own privacy policy and are responsible for it. We encourage you to read the privacy policy of any builder you engage with.

Others we may share it with

  • Finance partners — mortgage brokers, lenders and other finance providers, where you ask us to connect you or consent to a referral.
  • Land developers, estate sales teams and real estate agents — where relevant to a house and land package or a block you are considering.
  • Our service providers — including our website host, customer relationship management (CRM) system, email and calendar providers, cloud storage, phone and SMS systems, e-signature tools and marketing platforms. These providers are only permitted to use your information to provide services to us.
  • Our professional advisers — lawyers, accountants, auditors and insurers, where reasonably required.
  • Anyone you authorise — including your partner, family member, accountant, conveyancer or buyer’s agent, where you tell us to deal with them.
  • Government agencies, courts and regulators — where required or authorised by law.

We do not sell your personal information, and we do not provide it to other organisations for their own direct marketing.

6. Direct marketing and how to opt out

If you have dealt with us or provided your details to us, we may contact you by email, SMS, phone or post with information about our services, builders in our network, house and land opportunities, and building market updates.

You can opt out at any time — use the unsubscribe link in any marketing email, reply asking us to stop, or contact us using the details in section 14. We will action your request promptly and at no cost. You may also ask us to tell you where we obtained your information.

Opting out of marketing does not stop us contacting you about a consultation you have booked, a builder introduction already under way, or other service-related matters.

7. Sending information overseas

Some of the service providers we use — particularly cloud hosting, CRM, email and analytics providers — may store or process personal information outside Australia, most likely in [the United States and other countries where those providers operate data centers].

Before disclosing personal information to an overseas recipient, we take reasonable steps to ensure they handle it in a way consistent with the Australian Privacy Principles, including through the terms of our contracts with them.

8. Cookies, analytics and our website

Our website uses cookies — small text files stored on your device — to keep the site working properly, remember your preferences and help us understand how people use the site. Some cookies are essential for core functionality, while others help us improve your experience.

You can set your browser to refuse cookies or alert you when a cookie is being set. If you disable cookies, some parts of the site may not work as intended.

  • Remarketing Tags — allow us to show ads to visitors who have previously interacted with our website.

Our website may also include interactive tools that let you visualise a home on a block or explore floor plans. Any information you enter into these tools is treated the same way as any other information you give us.

If we add new tools or tracking technologies, we will update this section.

9. How we keep personal information secure

We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include access controls and password protection, reputable cloud systems, confidentiality obligations on our staff and the builders and providers we work with, staff training, and secure destruction of records we no longer need.

No system can be guaranteed completely secure, and information you send us over the internet is sent at your own risk. If a data breach occurs that is likely to result in serious harm, we will assess it and, where the Notifiable Data Breaches scheme applies, notify affected individuals and the Office of the Australian Information Commissioner (OAIC).

We keep personal information only for as long as we need it for the purposes described in this policy, or for as long as the law requires — generally 7 years after our last dealing with you. After that we destroy it or de-identify it.

10. Accessing and correcting your personal information

You can ask us for a copy of the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. Contact us using the details in section 14.

We will need to verify your identity before we can act on your request. We will respond within 30 days. Access is usually free, although we may charge a reasonable fee to cover our costs where a request is substantial. If we cannot give you access or make a correction, we will explain why in writing and tell you how to complain.

11. Complaints

If you think we have mishandled your personal information or breached the Australian Privacy Principles, please tell us first so we can put it right. Contact our Privacy Officer using the details in section 14.

We will acknowledge your complaint within [5] business days and aim to resolve it within 30 days. We may need to ask you for more information, and we will tell you the outcome and our reasons in writing.

12. Other websites

Our website may link to builder websites, land estate websites, government grant pages and other third-party sites. We are not responsible for the content or privacy practices of those sites, and this policy does not apply to them.

13. Children

Our services are directed at adults. We do not knowingly collect personal information from anyone under 18 without the involvement of a parent or guardian. If you believe we hold information about a child, please contact us and we will delete it.

14. Changes to this policy and how to contact us

We may update this Privacy Policy from time to time. The current version will always be available on our website, with the date it was last updated shown at the top. Where a change is significant, we will take reasonable steps to notify you.
